The Board has never granted such a broad request to waive <br />all applicable aspects of Ordinance 83-24. Waivers that have been <br />granted by the Board have involved more minor issues, such as the <br />location and provision of sidewalks and the ability to directly <br />access a Thoroughfare Plan road. Granting the request would <br />render Ord. 83-25 ineffective, because all current and future <br />illegal subdivisions would be similarly situated. Granting the <br />request would set an untenable precedent: that the subdivision <br />regulations apply to all properly developed residential projects <br />but not to illegal subdivisions. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners deny the <br />request by Mt.
