Commissioner Bird wished to know what needs to happen in the <br />future to clear up this problem so that this lot and others in <br />here can become buildable. <br />Chief Planner Boling advised that most of the people who <br />own, orare buying, these properties are from out of state and <br />have never seen the property, and the first entity that started <br />these contracts is not the company that owns them currently. As <br />well as working with the applicant, staff also has tried to work <br />with the current owner of all these contracts and have them <br />contact the mortgagors and alert them as to the situation. He <br />pointed out that the property under discussion is located next to <br />Boxwood Estates and this area is ripest for development; they <br />just need to extend 14th St. S.W. into their property and plat <br />it. Planner Boling felt it probably will be necessary to <br />assemble these properties to make it feasible to develop them. <br />The Chairman asked if anyone present wished to be heard. <br />Attorney Michael O'Haire came before the Board representing <br />the First Baptist Church of Mt. Pleasant. He informed the Board <br />that this situation is a result of a real estate scam that took <br />place in the late '60s. This is an unapproved subdivision,; the <br />developer has disappeared; and the current owner is the party who <br />lent the developer money and then took over the property when he <br />ran out. Mt. Pleasant Church is simply one of the many who <br />innocently purchased this property. <br />Attorney O'Haire explained that in the case of the church, <br />the agreement for deed was signed in 1972 when there was a <br />different ordinance altogether in place, and many other deeds go <br />back to .the late 60's. Staff's position is that this land was <br />not subdivided when the people agreed to pay their money and the <br />agreement for deed was signed, but that it was subdivided only <br />when the deed came out after they had paid all their money for <br />land, which is what is happening now.
