We feel that the above information fully describes the reasons <br />for the Additional Services claim and that considerable funds <br />have been waived to expedite this item. We have given Indian <br />River County every Professional Service required by our contract <br />and in many instances beyond that which is required. We simply <br />cannot absorb this cost in our fee and must be reimbursed. <br />We respectfully request your favorable consideration of the above <br />request. <br />Sincerely, <br />W. R. Disney ,/ <br />Director of Architectural Production <br />Commissioner Bird respected the Attorney and staff reviewing <br />this and saying we are obligated to pay it; however, he could not <br />help but question that the architects had to spend over an hour a <br />day on each of these extra days, and he was curious just what is <br />involved as far as the architect is concerned to cause them to <br />run up these kind of charges. <br />Dalas Disney of Frizzell Architects felt that waiving the <br />$10,000 they have agreed to waive indicates that they have <br />greatly in excess of what they have billed for, and as to the <br />hour a day questioned by Commissioner Bird, they have in their <br />office a mountain of paperwork as a result of this contractor <br />being in excess of nine months late with the project. Mr. Disney <br />advised that typically they do not go through this process no <br />matter how late the contract is, but they have had many negotia- <br />tions and interim conversations with this particular contractor, <br />and frankly it is a total lack of cooperation on his part that <br />has led to this many hours. Mr. Disney felt, if anything, that <br />Frizzell Architects has bent over backwards not to come back to <br />the County for additional funds, but they simply cannot absorb <br />this. They are absorbing $10,000 for Phase I and Phase II; <br />they are still working in the county's behalf and still have <br />documents that the contractor owes them; and if he may correct <br />Mr. Balczun, they have not recommended final payment; they have <br />recommended substantial completion.
