Attorney Vitunac advised that the County Attorney's Office <br />has contacted the Marine Patrol, and it appears that we have to <br />go through a formal procedure of at least applying for a letter <br />permit, and failing to do that, any signs that are put up in <br />there will be declared a nuisance and would subject the County to <br />liability and will be taken down immediately. <br />Commissioner Bowman advised that Pat Rose of the DNR told <br />her that a County ordinance would solve the problem for these <br />people, but in the meantime, the land owners can put the signs on <br />their own property. The signs would have no teeth, so to speak, <br />but they would serve as good public relations for the manatee. <br />Commissioner Bowman urged that we declare the area from the <br />Sebastian River over to the John's Island area a sanctuary and <br />have it included in the Comprehensive Land Use Plan. <br />Attorney Vitunac emphasized that in order to put the signs <br />in the water, we have to go through a format procedure. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, the Board unanimously authorized <br />staff to do whatever can be done to get some "no wake" <br />signs in John's Island Sound as quickly as possible. <br />MOTION WAS MADE by Commissioner Bowman, SECONDED by <br />Commissioner Eggert, that the Board direct staff to <br />draft a county ordinance creating a manatee sanctuary <br />for the entire county and to incorporate it into the <br />County's Comprehensive Land Use Plan. <br />Under discussion, Commissioner Eggert stated that she would <br />support the Motion provided it does not remove boating from those <br />areas, especially John's Island Sound, but Commissioner Bowman <br />stressed that it would never affect boating in the Intercoastal <br />Waterway. <br />16 <br />1988 <br />BOOK 1 i f,10E 444 <br />
