The applicant agrees that the original design would cause <br />additional flooding in Vista Gardens and has re-routed the <br />stormwater outfall to alleviate the flooding potential. The <br />Public Works Director has reviewed and approved this new <br />outfall. The new outfall will also require permit modifi- <br />cations through the St. John's Water Management District. <br />10. Proposed Utilities: The site will be serviced by County <br />water and wastewater. The connection has been conditionally <br />approved by the County Utilities department. The Utilities <br />department recommends that the applicant fully demonstrate <br />the adequacy of the Vista wastewater plant and collection <br />system, and be financially liable for improvements needed for <br />the plant and the collection system. <br />11. Dedications & Improvements: The applicant has agreed to: <br />1. Dedicate 15' of property parallel to the U.S. #1 right- <br />of-way as depicted on the site plan, prior to site plan <br />release. <br />2. Construct a 5' wide public sidewalk along the site's <br />U.S. #1 and Indian River Blvd. frontage as depicted on <br />the site plan, prior to certificate of occupancy. <br />3. Provide a marginal access easement and record a marginal <br />access easement agreement, prior to release of the site <br />plan. <br />4. Relocate an access easement to the County, prior to site <br />plan release. <br />5. Make some of the existing transplanted/relocated trees <br />(e.g. palms and saplings) available to the Vista Gardens <br />Homeowner's Association, prior to any tree removal. <br />6. Five lane U.S. 1 to accommodate construction traffic, <br />prior to site plan release. <br />12. Open Space Required: 20% <br />Provided: 26.5% <br />13. Administrative Permit Criteria: The following administrative <br />permit criteria is applicable: <br />(2) Department store, furniture and appliance sales, show- <br />room catalog stores, and variety store (Administrative <br />Permit). <br />a. Districts requiring administrative permit: Depart- <br />ment stores, furniture and. appliance sales, show- <br />room catalog stores and variety stores may be <br />allowed in CL District upon receiving approval as <br />an administrative permit as provided in Section <br />25.2 and after meeting the requirements defined <br />below. <br />b.
