Chairman Scurlock did not concur with Director Keating's <br />statement that there was some vesting. He was not sure that just <br />because someone gets approval originally, which they did, it <br />necessarily vests them from the standpoint of the Commission <br />approving a site plan, particularly when we can identify that <br />substantial harm could come to adjacent properties. He believed <br />that if an error was made, and if, indeed, we can say that it did <br />occur, the Commission has the ability to address that issue <br />through the site plan process. <br />Director Keating advised that Public Works Director Jim <br />Davis and Traffic Engineer Mike Orr coordinated the preliminary <br />traffic analysis. Wilbur Smith did the first preliminary <br />analysis for the applicant in the original submittal, and <br />Kimley-Horn did the analysis in the latest submittal. <br />Chairman Scurlock asked if there was a conflict of interest <br />on Kimley-Horn's part in that they represented the County on <br />Indian River Boulevard and now they are representing the <br />developer. <br />Director Davis explained that basically, Kimley-Horn's scope <br />of work in designing Indian River Boulevard was to design the <br />roadway geometrics and the drainage. The County, basically, did <br />the traffic studies in-house. <br />Chairman Scurlock assumed then that Kimley-Horn would not be <br />testifying or entering information as to the traffic capacities <br />or that sort of thing. <br />Planner Stan Boling pointed out 3 critical intersections: <br />1) The entry road from Vista Trail up to Indian River <br />Boulevard, especially the left-hand turn movements going <br />towards U.S. #1. <br />2) The intersection of 4th St. and U. S. #1. <br />3) The intersection of 1st St. and U.S. #1. <br />Mr. Boling advised that the developer has committed to 2 <br />major types of improvements at U.S. #1 and 4th Street <br />intersection: <br />26 <br />APR 5 1988 <br />BOOF <br />` 1 a[,E 454 <br />
