U.S. #1, and Attorney O'Haire explained that the developer has <br />agreed to construct a 5th lane, a left-hand lane turning south <br />off of U.S. #1 in front of the site, which staff and the traffic <br />consultants have identified as being required to maintain LOS <br />IDn. <br />Director Keating emphasized that the turning lane would be <br />built before construction begins so that construction traffic can <br />use that left -turn southbound lane. <br />Chairman Scurlock asked Director Davis for his professional <br />opinion on whether it is a safe situation to co -mingle traffic <br />between a residential entranceway and a commercial, and Director <br />Davis stated that in his opinion, the type of vehicle is <br />important. If there is co -mingling of large trucks which have <br />large turning radii and that type of thing, then there could be <br />some safety problems. If proper signalization is imposed and if <br />the traffic control is set up properly with adequate site <br />distance with respect to vegetation, etc., it could be made a <br />safe situation. <br />Attorney O'Haire noted that the applicant has offered to <br />both the TRC and the P & L to restrict by signage the type of <br />vehicle that goes through that particular intersection. <br />In conclusion, Attorney O'Haire reemphasized that the <br />applicant has met all of the standards and abided by all of the <br />rules established by county ordinance. He felt that if the Board <br />denies that the applicant has met all of the requirements, they <br />were backing themselves into a condemnation situation, which <br />could be the magnitude of 7 figures. However, if as a judgement <br />call, the Board is willing to back themselves in that situation, <br />then he would not quarrel with that, but would go on from there. <br />Attorney O'Haire introduced Mike Bird, a State registered <br />traffic engineer with Kimley-Horn, who explained what traffic <br />i <br />counts actually would have to be met and how they analyzed the <br />intersections of Indian River Boulevard and the Vista access <br />road, U.S. #1 and 4th Street, and.
