Environment <br />The site is not designated as environmentally sensitive, nor is <br />it located in a flood prone area. <br />Utilities <br />Public water facilities are currently available to this area to <br />the south along Oslo Road. <br />Conclusion <br />Staff feels that, because this property has been in its current <br />use for at least ten years, this request is not really an <br />expansion of the MXD land use, but more of a clarification and <br />correction of the actual land use for this property. Further, <br />its dimensions and size are not a substantial increase in this <br />MXD area and will not encourage or legitamize additional similar <br />requests. This land use/zoning amendment should not have any <br />substantial adverse impacts on this area and is consistent with <br />the area's development. <br />RECOMMENDATION <br />Based on the analysis performed, staff recommends that the Board <br />of County Commissioners approve transmittal of this request to <br />the DCA for a change in the land use designation from LD -2 to MXD <br />for 1.11 acres. <br />The Chairman asked if anyone wished to be heard. <br />Attorney Sam Block came before the Board representing the <br />Zorcs and advised that they are here to answer any questions. <br />The Zorcs just bought the property last year, and it has been <br />used as a Mixed Use since 1975. <br />It was determined that no one else wished to be heard, and <br />the Chairman declared the public hearing closed. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bowman, the Board unanimously approved <br />transmittal of the above request for a change in <br />the land use designation to MXD to the DCA for <br />review. <br />REQUEST TO AMEND COMP PLAN BY EXPANDING THE CR510/US1 COMMERCIAL <br />NODE (STENGER) <br />This item was withdrawn from the agenda at the request of <br />Attorney O'Haire on behalf of Mr. Stenger. <br />22 <br />APP 2 6 1988 <br />BOOK 72 F'nE 181 <br />
