The Planning and Zoning Commission took <br />action to deny this application by a vote of 4 to 1 (see <br />attached minutes from the 3/24/88 meeting). <br />- March 25, 1988. The applicant was notified of the action <br />taken by the Planning and Zoning Commission at its meeting of <br />March 24, 1988 and was advised that affected parties have 10 <br />days from the date of the action to appeal the decision to <br />the Board of County Commissioners. <br />- April 8, 1988. Staff received a letter of appeal from the <br />applicant's attorney (see attached letter dated 4/6/88). <br />Following is an analysis of the information reviewed by the <br />Planning and Zoning Commission. <br />ANALYSIS: <br />1. Size of Lot: 1.79 acres (includes existing mobile home and <br />warehouse building). <br />2. Area of Development: 1.28 acres <br />3. Zoning Classification: ROSE -4 (Roseland Residential Dis- <br />trict) <br />Pursuant to the applicable "old" Section 15(b)(4) of the <br />County zoning ordinance, "the following home occupation uses <br />shall be permitted", within the ROSE -4 district, "after <br />receiving site plan approval and meeting the conditions <br />specified below": <br />a. Metal working and casting; <br />b. Contractor's office and storage of contractor's mate- <br />rials, tools and equipment; <br />c. Lawn mower and small engine sales, service and repair; <br />o <br />han <br />d. Service businesses (provided <br />same not in shall <br />excess nofmfourt (4) <br />one sign advertising th <br />square feet in size. <br />e. Criteria for home occupation uses. A11 homecoccupations. <br />shall be established based on the following <br />1. The activity is conducted only by members of the <br />family living within the residence; <br />2. Products are not offered for sale to the general <br />public and from the premises except as herein <br />otherwise provided; <br />3. Any evidence of the occupation is screened from the <br />street by Type "A" screening; <br />4. Traffic is not generated in excess of that custo- <br />mary for residential uses; <br />5. The property has been qualified for (and continues <br />to be qualified) for homestead exemption for ad <br />valorem tax purposes; and <br />6. All home occupation activities must meet yard <br />setback requirements. <br />In order to receive site plan approval, all of the preceding <br />requirements must be satisfied. The applicant has submitted <br />information concerning these requirements; however, it is <br />25 <br />
