� � r <br />County Attorney Vitunac suggested that perhaps their <br />preliminary plat could be approved subject to the Board moving <br />ahead with the ordinance change, and then they could put put up a <br />bond in the meantime to put the sidewalks in if the ordinance <br />change should not occur. <br />Chief Planner Boling advised that they already have <br />preliminary plat approval based on meeting the ordinance, whether <br />by a variance or otherwise. What they don't have is their land <br />development permit. <br />Chairman Scurlock believed Attorney Vitunac is suggesting <br />they post a bond allowing them to proceed subject to the <br />ordinance actually being modified. <br />Planner Boling pointed out that if the regulations did.not <br />relieve them of the improvements, they still would have to design <br />so that sidewalks could be put in. <br />Commissioner Bird asked if Mr. Votapka had said his client <br />was agreeable to putting sidewalks along 8th Street and Old <br />Dixie. <br />Mr. Votapka advised that there is no problem with putting <br />them along 8th Street; that is a foregone conclusion as far as <br />they are concerned. There are some sidewalks along Old Dixie, <br />but his client does not own ail the land along there. <br />The Chairman asked if anyone present wished to be heard. <br />There were none, and he thereupon declared the public hearing <br />closed. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Wheeler, the Board unanimously (4-0) agreed <br />to grant the Land Development permit based on the <br />applicant putting up a bond and designing the project <br />so that sidewalks could be put in and directed staff <br />to proceed with preparing an amendment to the ordinance <br />as discussed. <br />MAY 3 11988 44 Boa 72 F,� iu 449 <br />
