A G R E E M E N T <br />TH I S AGREEMENT, made this 17th day ' o f may <br />_T�__ . <br />1988, by and between INDIAN RIVeR-—C-OUNTY, apolitical <br />subdivision of the State of Florida, 1840 25th Street, Vero <br />Beach, FL 32960 (COUNTY), and WILDER CORPORATION, a <br />corporation existing under the laws of the State of Florida, <br />whose address is Post Office Box 2062, Vero Beach, FL 32960 <br />(UTILITY), <br />W I T N E S S E T H: <br />THAT FOR AND IN CONSIDERATION of the mutual <br />covenants and other valuable consideration, receipt of which <br />is hereby acknowledged, COUNTY and UTILITY agree as follows: <br />1. COUNTY shall take immediate steps to <br />physically connect the Village Green Mobile Home Park to the <br />COUNTY's water system to provide water to approximately 780 <br />mobile home units. <br />2. COUNTY shall charge its standard rate to the <br />UTILITY for the provision of potable water service, monthly <br />in arrears, based on metered consumption. <br />3. The COUNTY's obligation to provide temporary <br />water service through this connection point shall continue <br />for 120 days from the date of this agreement. After 120 <br />days, COUNTY shall have the right to increase its <br />consumption charge to UTILITY by 50%, which shall be a <br />penalty to induce. UTILITY to take other steps to provide <br />permanent water service. <br />4. UTILITY agrees to pay in advance of COUNTY <br />water service, a deposit as specified in COUNTY ordinance to <br />--secure the prompt payment of the monthly consumption charge. <br />5. UTILITY sha11 'take steps. to' provide permanent <br />water service through either renovation of its existing <br />water service plant or by permanent connection to the COUNTY <br />water system, which will entail the payment of impact fees. <br />6. UTILITY acknowledges that after 120 days from <br />this agreement, even though penalty rates may be in effect <br />on water consumption, the COUNTY has the right to disconnect <br />the temporary water 'connection on two weeks' notice to <br />UTILITY. <br />7.
