Commissioner Bird felt that standing water in these <br />neighborhood swales would make it difficult for the residents to <br />maintain those ditches, and Commissioner Bowman wondered if there <br />was some way we could contest this requirement. <br />Director Davis explained that if the Board wants to <br />authorize them to proceed with petition paving as we have done in <br />some projects in the past, then staff will not seek these <br />permits. However, it might be better to get some legal opinion <br />on that. <br />Commissioner Wheeler felt that if this is a problem for the <br />City of Vero Beach and everybody else, perhaps we should sit down <br />and solve this problem. <br />Director Davis explained that the Water District's <br />stormwater management law establishes certain performance <br />criteria that must be met before any paving can be done. It is <br />an effort to keep the waters clean in this state. He did not <br />feel that retaining 1/2" in the swales will help all that much, <br />and emphasized that the paving of the road eliminates a lot of <br />the silt that is washed into the system, and the grass swales <br />filter the stormwater before it gets to the river. <br />Commissioner Bird wanted to see us request a hearing with <br />St. John's to see if we can be exempted from this requirement, <br />especially as it pertains to residential neighborhoods. <br />Director Davis asked the Board to authorize him to go ahead <br />on some of these projects today as he has a crew standing by and <br />would like to punch out a couple of the projects and then get the <br />permits for them. <br />ON MOTION by Commissioner Bowman, SECONDED by <br />Commissioner Bird, the Board unanimously (3-0) <br />accepted the proposal from Marshall, McCully s; <br />Associates at a fee of $250 per project; authorized <br />Public Works to proceed with the requested projects; <br />and requested staff to set up a meeting with the <br />Water District. <br />30 Boa 7 P.,GE ! 7 <br />JUN 24 i ... <br />
