Chairman Scurlock asked if we could use traffic impact fees <br />for a central bike path network, and Director Keating explained <br />that the impact fees could be used only if the bike paths are <br />being built in conjunction with a capacity -producing change to <br />the roadway. If you are building a new roadway such as Indian <br />River Boulevard to 53rd Street, you can include bike paths, but <br />you could not do that with Route #60 because you would not be <br />increasing the capacity. <br />Commissioner Bowman asked what the County Attorney would <br />recommend in this matter, and Attorney Vitunac advised that if <br />the Board has the consensus that the sidewalk in question is not <br />needed, they can offer the Moorings the same deal we offered <br />development on Old Dixie Highway, which is that they can proceed <br />by putting up a bond and agreeing to put the sidewalk in if the <br />ordinance is not amended. <br />Attorney Vitunac asked if the Moorings Development Co. is <br />contesting the dedication of the right-of-way along AIA for the <br />bike path, and Attorney Dorothy Hudson reported that the <br />dedication of the 10 -ft. right-of-way is still under discussion. <br />She emphasized that the right-of-way is a separate issue <br />altogether. <br />ON MOTION by Commissioner Bowman, SECONDED by <br />Commissioner Wheeler, the Board unanimously (4-0) <br />approved the posting of a -bond for the installation <br />of a sidewalk on Bowline Drive during the time the site <br />plan requirements are under modification, and directed <br />staff to proceed with the modifications in an <br />expeditious manner. <br />18 <br />�Ca9C�[h .73 <br />L_�JU� �81988 J <br />
