- M <br />The Board, after considering the application, the staff's and <br />Planning and Zoning Commission's recommendations, is to act upon <br />the request. The Board may attach any conditions and safeguards <br />necessary to assure compatibility of the use with the surrounding <br />area. <br />Proposed Use: <br />The staff is concerned about this use being defined as a residen- <br />tial center. The code defines residential centers in the follow- <br />ing way: <br />"...residential centers shall be defined as facilities <br />which provide a family living environment including <br />supervision and care necessary to meet physical, <br />emotional and social needs of clients. These facilities <br />may also provide education and training for resident <br />clients." <br />The applicant has provided staff with the following information <br />about the proposed use: <br />"The proposed development will consist of 80 one -bedroom <br />apartments and a community building specially designed <br />to meet the physical, emotional and social needs of the <br />elderly and handicapped tenants. Each apartment will <br />consist of a bedroom, living -dining room, bath and small <br />kitchen area. Eight of the apartments will be specially <br />designed for the handicapped, with full wheelchair turns <br />and otherwise barrier -free layouts. Each unit will be <br />equipped with an emergency call system which may be <br />activated by the tenant in case of emergency, or will be <br />automatically activated in case of fire or smoke. The <br />alarm system is monitored 24 hours a day by on-site <br />staff personnel. The residents are monitored twice a <br />day and must check out when leaving for extended <br />periods. <br />The community space will allow for the assembly of the <br />residents. A multi-purpose room will be included, with <br />space for viewing television, reading, playing cards, <br />bingo, puzzles, crafts and other family -and dommunity <br />type activities. A small kitchen is just off the <br />assembly area which can be used for catering -type <br />services. <br />A Regulatory Agreement with the Department of Housing <br />and Urban Development which restricts the use of the <br />facility to the purposes for which it was constructed, <br />for the term of the mortgage, 40 years, must be <br />executed. The maximum number of tenants per unit is <br />two. The Regulatory Agreement will assure local govern- <br />ment authorities that the use of the development will <br />not be changed for construction. <br />The Department of Housing and Urban Development requires <br />that each apartment contain kitchen facilities. To meet <br />this requirement, there will be a small stove and <br />refrigerator in each apartment." <br />Analysis of Use: <br />Staff feels this use displays many of the characteristics of a <br />residential center by providing supervision and care necessary to <br />meet physical, emotional and social needs of the residents. <br />However, staff also feels the best interpretation of the "family <br />living environment" clause in the definition calls for a more <br />communal atmosphere which would be provided by common eating <br />facilities and a dormitory style of living. In such a setting, <br />units are not independent but are dependent upon common facili- <br />ties.
