frustrated, and where she sees the problem to be is in the <br />question of management methods or techniques, time tables versus <br />the needs of the county, the county staff and the Board of County <br />Commissioners. Commissioner Eggert stated that she felt like we <br />have reached an impasse. A lot of people are at fault, but she <br />felt that for the Administrator's sake, our sake and staff's <br />sake, and for the sake of getting some of the things completed <br />that we need to get completed - she talked to him and he knew <br />what conclusion she came to - she asked him if he would be <br />willing to resign and apparently he is not. Therefore, that is <br />why she is seconding the Motion. <br />Commissioner Bird asked that County Attorney Vitunac refresh <br />his memory about Mr. Balczun's contract as far as what effect the <br />Motion has financially on the county. <br />Attorney Vitunac advised that the county has a rolling 90 <br />day notice employment contract with its Administrator which says <br />that at any given day the County can terminate the contract by <br />giving 90 days' notice. What that means is that the Administra- <br />tor has the right to work for 90 days and get paid for it, at <br />which time the termination provisions come into effect on the <br />compensation package which the Board bargained for 2 or 3 years <br />ago. It says one month severance pay plus one day a month for <br />every month the Administrator has worked, plus any accrued and <br />unused vacation time. So, if you give 90 day's notice, and the <br />Administrator works 90 days, he would at the end of the 90 days <br />get a check for one month plus the one day per month plus any <br />vacation time. If he resigns immediately, he gets paid to the <br />date of resignation with no severance pay. Those are the two <br />options. <br />Commissioner Bowman stated that for the information of the <br />public, she would like the County Attorney to specify exactly <br />what the contract says about cause. She believed he told her <br />that we can terminate the contract with 90 day's notice without <br />cause. Is that correct? <br />48 BOOK 73 ur,E 399 <br />
