Chairman Scurlock noted that at the time it was placed on <br />the agenda to modify the contract, we had two options and that <br />was either to continue on or modify the contract. It was a <br />number of Commissioner's intent at that point that there was some <br />dissatisfaction with the situation here with the Administrator, <br />and at that meeting, he felt the Commission made it very clear <br />there was a possibility of exercising that provision if, in fact, <br />a new contract was not negotiated with the 90 day (provision) at <br />that time, and that was the action the Board took at that time. <br />At that time also the contract was delivered to Mr. Balczun, and <br />he signed and I signed it. It was returned to me and sat on my <br />desk. <br />Attorney Vitunac then read the remainder of the letter from <br />Mr. Balczun's attorneys, which stated such an amendment was never <br />executed or agreed to by Mr. Balczun. <br />Commissioner Bird asked how they can state that the <br />amendment was never executed if it was executed. He guessed you <br />can state anything you want; it may not be true. <br />Attorney Vitunac clarified that the county proposed an <br />amendment which was agreed to at this podium at a public meeting. <br />Mr. Balczun delayed in signing his version of it. It got down to <br />a deadline - if we didn't have a signed agreement by the end of <br />March, 1988, he believed, the Administrator's original contract <br />would roll over for another year. It was discussed that if we <br />didn't get that signed contract back, we would call another <br />meeting and have to invoke our rights under the original <br />contract. Mr. Balczun then signed the agreement, and it went to <br />the Chairman for signature. (The Chairman interjected that he <br />signed it) and Attorney Vitunac continued that somebody lost the <br />contract; it has disappeared; no one has it. The Chairman told <br />somebody to go back and get another one signed from Mr. Balczun. <br />Mr. Balczun said he was busy at the moment, to leave it on his <br />desk, and it was never seen again and we do not have a signed <br />AUG 9 1988 51 BOOK 73 PnE 402 <br />
