Attorney Vitunac advised that he discovered that.a <br />week ago. <br />Attorney Vitunac stated that he would like to ask Mr. <br />Balczun at this point if he ever signed the first amended <br />contract. <br />Administrator Balczun informed the Board that his legal <br />counsel advises him that in his absence, he should refrain from <br />commenting on this matter. He does not have legal counsel <br />present this morning, and the only comment he can make on this <br />matter generally is to suggest that the action contemplated and <br />the Motion made and seconded is considered by both his legal <br />counsel and himself not only to be incorrect but to be wrongful. <br />He declined any further comment on the matter. <br />Attorney Vitunac recommended the Board proceed on the <br />assumption that we had a contract although it was lost. We have <br />live testimony that they have seen Mr. Balczun's signature on it; <br />discussion of the contract is in the Minutes; and we have a tape <br />of the meeting. Mr. Scurlock says he signed it, and there was <br />no delivery of that contract back to Mr. Balczun as far as we <br />know. <br />Chairman Scurlock commented that his office has been broken <br />into on at least three occasions. <br />Commissioner Eggert stated that a week ago Monday Mr. <br />Balczun stated to her that he reviewed the contracts, and she <br />assumed that he had both of them and that he was recognizing more <br />than one contract. So, she doesn't know how to feel about this <br />situation. <br />Commissioner Wheeler also noted we have the Minutes and the <br />tape of the meeting where we discussed that contract. We had <br />considerable discussion about it, and it was agreed to at that <br />meeting by this Board. <br />Commissioner Bird asked when we discovered we did not have a <br />signed contract that was supposed to be executed back in March. <br />52 <br />BOOK Id t 403 <br />
