Attorney Vitunac stated that he discovered it about a week <br />ago because he was told that, yes, he (Mr. Balczun) had signed <br />the contract and it had been delivered to the Chairman; other- <br />wise, we would have called a Special Meeting of the Board to <br />force the issue one way or the other. <br />Chairman Scurlock believed that issue, since Mr. Balczun is <br />reserving comment, will be a matter for, if we get to that point, <br />litigation and a suit. He personally believed there are a number <br />of individuals who will swear that they saw that document. He <br />personally will swear that he signed it; that it was signed by <br />Mr. Balczun; and his secretary's history of it then appearing <br />missing the next day; the reattempt to have it signed again; and <br />at that point he did not know what did or did not happen. He <br />believed that is a legal issue. <br />Commissioner Wheeler noted that as a lay person sitting <br />here, he has a little problem, too. This isn't a court of law - <br />and for someone not to state simply whether they signed a <br />contract or not. This isn't a murder trial - you either signed <br />the document or you didn't. <br />Commissioner Bird noted that if the contract wasn't signed, <br />he would think someone should have followed through. <br />Chairman Scurlock advised that we did. He directed <br />Commission secretary Alice White, once it became missing, to <br />follow up on it, and she delivered a new document to Mr. Balczun <br />through his secretary, Margaret Gunter, with the specification <br />that it needed to be signed, and basically he refused to sign it. <br />Commissioner Bird asked how long ago that was. <br />The Chairman did not know exactly, but Attorney Vitunac <br />noted that had to be before April 1st' because that was the <br />critical date, and if someone had told us that he hadn't signed <br />again because we lost the first one, we would have had a Special <br />Call meeting and given him notice under the original contract or <br />have him sign the amendment. <br />53 Boor 73 F,a;E 404 <br />U G 9 1998 <br />L_ <br />
