are very clear; in fact, on page 5 of the verbatim transcript, it <br />shows that Commissioner Wheeler even suggested tabling the matter <br />for another week or so, but Administrator Balczun said "No, 1 <br />think you ought to approve it the way it is because it's fairly <br />fair." The Chairman felt it is very clear and did not think we <br />need to spend our time here at the Commission level litigating <br />the matter. That is a matter between Mr. Balczun, if he so <br />chooses, and our legal staff and a court of law, and whatever <br />that decision is, that it is what it is. <br />Attorney Vitunac wished to ask Mr. Balczun one question, and <br />that is - "When you say that you are ready to work for 90 days, <br />are you proceeding as if there is an amendment to your original <br />contract." <br />Administrator Balczun replied that his attorneys instructed <br />him that he should refrain from commenting on this matter. <br />Commissioner Wheeler interjected that he did not see how you <br />can work with somebody like that! <br />Commissioner Bird at this point wished to ask the Adminis- <br />trator if he worked during the 90 days, how he would handle the <br />two major personnel vacancies we have right now - Blankenship and <br />Mary Kiser. Is it his intention as the Administrator to handle <br />that situation and make a recommendation quickly to either get <br />those people on board and working or off the payroll rather than <br />the status they are in. <br />Administrator Balczun stated that he would handle those on <br />the advice of the County Attorney and take whatever steps he <br />recommended. <br />Commissioner Bird agreed that the County Attorney can give <br />the Administrator advice, but Mr. Balczun is Administrator of the <br />county and is the one who must make the final decision. They are <br />his employees. He, therefore, asked if Mr. Baiczun is prepared <br />to make that decision and on his own and in a timely manner. <br />Commissioner Bowman interrupted at this point noting that <br />AUG. 10., <br />5 BOQK 73 FAF. 417 ', <br />
