Administrator Collins suggested that we could send him a <br />release along with the check, but whether he will sign it or not <br />is another question. <br />Commissioner Eggert felt it might be worth trying to see if <br />he will. She didn't see what we have to lose by sending a <br />release. <br />Administrator Collins explained that if we think we have a <br />90 -day contract, which we do, then it is simplest and cleanest <br />for us to go ahead and honor what we believe are the facts. The <br />fact that Mr. Balczun says that he did not sign the contract may <br />be some evidence of dereliction of duty and cause for firing, but <br />to bring in the issue of do we have cause along with what <br />contract does exist, the whole thing gets much more complicated <br />and the legal fees for the County get much more complicated. It <br />would be easier to go into court with clean hands saying we have <br />done what we think is right. If Mr. Balczun wants to contest it, <br />we feel we have a very defensible position, and we can still <br />raise some of these issues as a counter. <br />Commissioner Bird felt that the very most we owe him is what <br />we agreed to in the amended contract, and that was the 90 -day <br />notice of termination, and we have made the decision that we are <br />going ahead and pay him that and relieve him of his duties. That <br />has been done and whatever other severance and vacation, etc. <br />This is the absolute most that he is entitled to, and if Mr. <br />Balczun is willing to accept that, we are agreeable to paying <br />that, and we can shake hands and go on about our business. If he <br />is not agreeable to that and wants to try to claim that the <br />amended contract is not in force and wants to be paid all the way <br />into October, 1989, he would think that the Board would want to <br />fight that action with all the resources available to the County <br />because there is absolutely no way he is entitled to that.
