Commissioner Bird emphasized that he was not looking for a <br />compromise between what we are offering now and what Mr. Balczun <br />is looking for in October, and stressed that they are going to <br />have a hard time convincing him personally if they think we are <br />going to compromise and give him something in between that. <br />Commissioner Eggert agreed with that and what our Legal <br />staff have said, but wished there was some way we could pay it <br />into a fund pending the outcome of their decision of what to do. <br />Attorney Vitunac explained that if we do what we just said, <br />the minimum we will pay him will be also the maximum. It will be <br />exactly what the contract says. We will be giving up something, <br />and that will be our ability to fire him for cause as we will <br />have paid the money on the 90-day notice. He will have to sue, <br />and anything over that we think we can defend successfully. <br />However, we will not have a chance to give him no money. Even if <br />we can defend on certain gross dereliction of duties, it would <br />just get us back to the amount of money we already have paid him. <br />Commissioner Wheeler felt that firing with cause is totally <br />legitimate, but he has complete and total confidence in our Legal <br />staff and their recommendations and that is why he went with the <br />90-days notice pay. Secondly, holding our end of the bargain on <br />the 90-day contract is important as we sit here as a body to do <br />what is legitimate and what is right, regardless of who we are <br />dealing with. He did not want us to be put in the same position <br />that he feels Mr. Balczun has put himself. We are doing what is <br />legal, what is right, and what is honest. <br />Commissioner Eggert felt that we also need to look to the <br />future because we are looking for a new County Administrator, and <br />felt that we have tried very hard to be fair and that we should <br />go ahead and pay that 90 days. <br />Chairman Scurlock felt that is the most difficult part of <br />this; these personnel matters are at best difficult, especially <br />when you have to do it in such a public way.
