Douglas, acting as agent for Ms. Cornelia A. Harper, has <br />submitted a request to split Lot A, Hidden Acres Subdivision into <br />two ±1/2 acre parcels. <br />Pursuant to Section 6(a)6 of the County's subdivision ordinance, <br />any proposal to split a lot in a platted subdivision "which <br />results in construction sites smaller than or inconsistent with <br />the surrounding lots in a subdivision, shall be approved by the <br />Board of County Commissioners". Furthermore, the ordinance <br />requires a public hearing before the Planning and Zoning <br />Commission, and the Board of County Commissioners. <br />Planning and Zoning Commission Action <br />At its regular meeting of July 28, 1988; the Planning and Zoning <br />Commission voted 4 to 2 to recommend to the Board of County <br />Commissioners that this lot split be approved without attaching <br />staff's recommended condition (see attachment #5). The condition <br />appears at the end of this report in staff's recommendation. <br />BACKGROUND: <br />The Hidden Acres subdivision, located on the north side of 8th <br />Street and accessed via 23rd Avenue, is zoned RS -6, Single -Family <br />Residential (up to 6 units/acre), and has an LD -2 Low Density <br />Residential 2 (up to 6 units/acre) land use designation. The <br />subdivision, platted in 1955, consists of 7 one acre lots and 2 <br />half acre lots (previously split years ago). A majority of the <br />lots have been developed. The single, private road is unpaved and <br />is maintained by property owners within the subdivision. <br />ANALYSIS: <br />Consideration of this type of request is governed by five (5) <br />criteria specified in the subdivision ordinance. These criteria <br />state that, prior to granting approval, the Board must determine <br />that the proposed split and any other similar splits: <br />- would have no adverse impacts on the neighborhood; <br />- would result in "buildable" lots; <br />- would not conflict with any filed covenants and deed <br />restrictions; <br />- would not adversely impact existing infrastrucure; and <br />- would conform to all applicable county zoning <br />requirements. <br />A u G 2 3 188 5 6 BOOK 73 f'� <br />
