W <br />station has been completed for several months -and we have been <br />trying to get a contract with a certified hauler to dispose of <br />this material. The contract before the Board is copied from a <br />sample contract which has been approved by the DER. <br />Commissioner Bowman noted that the contract conditionally <br />exempts small quantity generators, and Mr. Dean advised that a <br />small quantity generator is someone that generates less than half <br />a drum of hazardous waste a month in their business. If we get <br />into a contract with handling the conditionally exempt, it <br />requires different permitting and a lot more preparation than we <br />have facilities to accept at the Landfill. He, therefore, would <br />like to stay completely out of that and collect for the home <br />owners only. He further explained that the hauler we are <br />contracting with is for the homeowners. The conditionally exempt <br />and the other generators will have to arrange their own contract <br />with this hauler or someone else. <br />Chairman Scurlock believed the answer is that those who <br />generate the hazardous waste are not exempt from having to <br />deposit it in the proper place and have it taken care of. This <br />is just our effort to make available a process for it to get to <br />the right place. <br />Commissioner Bowman commented that the contract also refers <br />to hazardous wastes that are not landfilled and wanted to know if <br />that means some are going to be landfilled. <br />Mr. Dean stated that they will not be at our Landfill, but <br />at other facilities that are properly licensed and equipped, and <br />they are not in the State of Florida. <br />Commissioner Bowman then noted that there is a provision <br />about liability resulting from "negligent supervision," and she <br />wished to know who is supervising this facility. <br />Mr. Dean explained that we have this collection facility at <br />the Landfill and our supervisors are supervising that facility. <br />Commissioner Bowman still wished to have the item tabled for <br />a week so she could go over the contract with the Attorney. <br />SEP 6 1988 20 BOOK ���,���20 <br />L_ <br />I <br />
