ORDINANCE NO. 88- 39 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, <br />AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING <br />ZONING MAP FOR THE PROPERTY DESCRIBED HEREIN, AND <br />PROVIDING FOR EFFECTIVE DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as <br />the local planning agency on such matters, has held a public <br />hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County Commissioners has determined <br />that this rezoning is in conformance with the Land Use Element <br />of the Comprehensive Plan of Indian River County; and <br />WHEREAS, The Board of County Commissioners has held a <br />public hearing pursuant to this rezoning request, at which <br />parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning <br />of the following described parcel situated in Indian River <br />County, Florida, to -wit: <br />The subject parcels being described as: <br />All that part of the SE $ of SW $ of Section 28 Township <br />31 South, Range 39 East, lying east of the east R/W of the <br />F.E.C.R.R. less right-of-way of record. <br />All that part of government Lot 5, Section 28 Township 31 <br />South, Range 39 East. Lying west of the west R/W of U.S. <br />Hwy No. 1 and west of the west R/W of Old Dixie Highway. <br />Less rights-of-way of record. Said parcels containing <br />16.28 net acres. Being more fully described as: Begin at <br />northwest corner of government Lot 5, Section 28, Township <br />31 South, Range 39 East, run west to F.E.C. Railroad <br />right-of-way, thence run southeasterly along railroad <br />right-of-way to State Road 510, thence run east along <br />State Road 510 right-of-way to westerly right-of-way of <br />Old Dixie Highway; thence run north along westerly <br />right-of-way of Old Dixie Highway to U.S. Highway No. 1; <br />thence run northerly along westerly right-of-way of U.S. <br />Highway No. 1 to north line of said government Lot 5; <br />thence run west to point of beginning.
