Nearing REFERENCES: Grant Agree. <br />Staff Planner DIS:JEFF2 <br />It is requested that the information presented herein be given <br />formal consideration by the Board of County Commissioners at their <br />regular meeting of September 6, 1988. <br />DESCRIPTION AND CONDITIONS <br />After having submitted to the state Bureau of Historic <br />Preservation several grant applications approved by the Board of <br />County Commissioners, Indian River County -has been awarded <br />$12,500.00 in Federal Historic Preservation Grants-in-aid. This <br />money has been awarded to the County to conduct a survey of <br />historic resources situated within the unincorporated portions of <br />the County. The grant program is being administered by the State <br />Bureau of Historic Preservation, which will provide funds for the <br />county to enter into a contract with a professional to conduct the <br />survey. <br />The staff was informed in February, 1988, that the County had been <br />awarded these funds. However, delays by the State in processing <br />the grant award have delayed commencement of actual survey work. <br />In August, 1988, the Planning staff finally received the official <br />grant agreement documents. With the receipt of these documents, <br />the staff commenced work on preparing a Request For Proposals <br />(RFP) to solicit perspective consultants. <br />ANALYSIS <br />As with all contractual agreements, the planning staff forwarded a <br />copy of the grant agreement to the County Attorney's Office for <br />review. After their review, the attorneys informed the Planning <br />staff that they had some concerns over some of the "boiler plate" <br />wording in the Agreement document. Their primary concern was over <br />several clauses holding the State harmless in the event that the <br />funding was not available, or was withdrawn. <br />In discussion with Historic Bureau Staff, the Planning Staff has <br />found that the funding is available and could only be withdrawn <br />through a special act of the legislature. The Historic Bureau <br />feels that this is a remote possibility. The Historic Bureau <br />staff has also informed staff that the wording in question is a <br />standard part of all contracts, and required by Florida Statues to <br />be in all state contracts. <br />P <br />86 BooK 74 r'ni 86 <br />X14 <br />
