Transportation Impacts <br />The site has access to C.R. 510, classified as a major arterial on <br />the County Thoroughfare Plan. Currently, this road is operating <br />at a Level of Service "A", This rezoning will have no additional <br />impact on the transportation system. <br />Environment <br />The Comprehensive Plan does not designate the subject site as <br />Environmentally Sensitive. However, this area is within an area <br />subject to flooding. <br />Conclusion <br />In reviewing this request, staff examined the potential impacts of <br />this request on the surrounding property. Normally, if the staff <br />were approached concerning a rezoning of 38 acres of vacant land <br />to A-1, and the land was adjacent to a -populated residential area, <br />certain concerns and reservations would be expressed. However, in <br />this instance, the request concerns land which has been in use as <br />grove since the 1950's. Very little area is remaining which would <br />permit further expansion. Basically, the grove is at or very near <br />capacity. Though expansion of a non -conforming grove is not <br />permitted, this grove can continue to operate, replace dead tree <br />stock, and remain an active on-going trade indefinitely. The use <br />will cease only if it is destroyed by more than 50%, or ceases <br />operation for more than 90 days. This rezoning will change only <br />the conformity status of the grove, and have no influence on the <br />already existing conditions. <br />RECOMMENDATION: <br />Based on the analysis performed and the recommendation of the <br />Planning and Zoning Commission, staff recommends approval of this <br />request. <br />Chairman Scurlock opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. <br />Janice Broda, 9335 Frangipani Drive, emphasized that "good <br />faith" was a phrase used repeatedly by both Chairman Scurlock and <br />Commissioner Bird to describe the intent and actions of Kennedy <br />Groves in the land clearing violation hearing on February 16, <br />1988. She expressed her disappointment that the Board chose not <br />to fine Kennedy Groves even nominally for having clearly violated <br />the tree protection ordinance. <br />Chairman Scurlock pointed out that the issue today is the <br />rezoning, and Director Keating advised that the Board made it a <br />condition of the land clearing violation that the applicant <br />submit and go through the rezoning, and this is an accumulation <br />of the entire matter. <br />
