Mrs. Broda had no quarrel with the rezoning, but wished to <br />take this opportunity to say something for the record that she <br />did not get a chance to say during the violation hearing before <br />this Board on February 16, 1988. She understood that the <br />Commissioners based their decision not to fine Kennedy Groves <br />upon the fact that Kennedy Groves acted in good faith; however, <br />she contained that perhaps they did not act in good faith when <br />they at the request of the adjacent property owners, who feared <br />for the safety of their homes, cut down a row of Australian Pines <br />and left the debris along the property line. This debris <br />attracted rats and other vermin, and after removal requests from <br />the adjacent property owners were ignored, the Public Health <br />Dept. intervened. Removal of this debris grew into a full-blown <br />land clearing operation in which a buffer of native oak hammock <br />was completely destroyed. She wondered if Mr. Kennedy acted in <br />good faith in the course of this land clearing, and felt that <br />someone acting in good faith would return the calls of his <br />neighbors who were concerned about the land clearing and also <br />would have admitted immediately to the County's environmental <br />planner that trees other than Australian Pines had been removed. <br />Mrs. Broda stated that Mr. Kennedy told the environmental planner <br />that she had lied and that no oaks had been removed, but <br />photographic evidence and the testimony of other home owners has <br />proven otherwise. She felt someone who is acting in good faith <br />would have complied with the requests from the County staff to <br />refrain from planting the additional row of citrus trees until <br />the land clearing matter was settled, but Mr. Kennedy went ahead <br />and planted the additional row of citrus trees nonetheless. Mrs. <br />Broda felt the most compelling evidence that Kennedy Groves did <br />not act in good faith was when B. T. Cooksey, counselor for <br />Kennedy Groves, stated at the February 16th meeting that the <br />reason Kennedy Groves did not want agricultural zoning is because <br />every time they spray or fertilize they get complaints from the <br />48 <br />SEP 131988 BOQK 74 191 <br />
