M <br />Bottle Clubs. <br />No studies currently exist which address <br />several assumptions can be made. Since <br />highly regulated in terms of hours of <br />consumption, the possibility for several <br />exists. <br />bottle clubs. However, <br />bottle clubs are not <br />operation and liquor <br />major adverse impacts <br />Without control on hours of operation, a bottle club could. <br />conceivably operate throughout the night. This results in late <br />night traffic flows, late night lighting of parking areas, and <br />late night noise. When these activities occur during normal <br />sleeping hours, such activities can have a substantial impact on <br />adjacent residential areas. Because of their. operational <br />characteristics and the absence of regulation on them, bottle <br />clubs can have a tendency to disrupt areas in other ways, <br />including a higher number of intoxicated patrons and higher <br />incidences of disruptive behavior. For those reasons, it is <br />staff's opinion that bottle clubs should be regulated by setting <br />hours, of operation, limiting locations, and setting separation <br />distances.. <br />Alcohol and Nudity <br />Bottle clubs are not currently regulated under the County laws <br />pertaining to nudity in places where alcohol is sold for on-site <br />consumption. Bottle clubs could, in effect, become adult enter- <br />tainment places where alcohol can be consumed. This is contrary <br />to -the--spirit and intent of the current County ordinance. As <br />explained .in the*attached. adult entertainment report, this use <br />tends to impact. crime, -property values, and traffic. When these <br />impacts are combined with the potential problems identical with <br />bottle clubs, this'coiild: result in adverse effects upon the <br />community. Staff's opinion. is.: that places where" alcohol is <br />consumed should be subject to the same regulations that.currently <br />govern nudity in places where alcohol is sold for on-site <br />consumption. <br />RECOMMENDATION <br />Staff has prepared three sets of proposed -regulations. <br />Adult Businesses <br />The first set deals with control of adult businesses. It places <br />them in the IL, Light. Industrial, and IG, General Industrial <br />districts. In general, these districts are the most removed from <br />residential areas and from more retail oriented commercial areas. <br />This will minimize impacts on adjacent residential areas. <br />Further, the criteria establish a 1000 ft. separation from other <br />adult businesses to disperse impacts, and from residential areas, <br />churches, schools, parks and playgrounds to protect those uses. <br />Bottle Clubs <br />The regulations for bottle clubs place this use in areas more <br />removed from residences, those being the CG, General Commercial, <br />and CH, Heavy Commercial districts. It also establishes adequate <br />buffering and separation distances. The separation distance of <br />1000 feet from other bottle clubs will minimize and disperse <br />impacts. The separation from churches, schools, parks and <br />playgrounds is similar to that required of other uses where <br />alcohol is consumed on-site. Additionally, hours of operation <br />have been set to minimize the impacts on adjacent residential <br />uses. <br />Alcohol and Nudity <br />Staff recommends that Chapter 2-3 dealing with nudity in places <br />where alcohol is sold for on-site consumption be amended to <br />include establishments where alcohol is consumed on-site. <br />Staff recommends the approval of these ordinance amendments. <br />27 p <br />SEP 2 0 N80 BOOK 74 <br />
