M <br />Chairman Scurlock stated that his concern with bottle clubs <br />is that they can just get some storeroom type structure basically <br />to set up their operation very inexpensively and circumvent our <br />established hours of operation. He wondered if the County could <br />pass an ordinance to license bottle clubs. <br />Planning Director Keating advised that licensing is one <br />means -other jurisdictions have used to control these types of <br />uses. Staff, however, felt that zoning limitations, separation <br />distances and restriction to certain districts, was probably a <br />better way. <br />The -Chairman believed that licensing could be another aspect <br />beyond meeting those certain requirements, and Commissioner <br />Wheeler also felt it would be easier if we could just revoke <br />their license for a violation rather than having to go through <br />all the hearings just to fine them, and then be ignored. <br />Chairman Scurlock stated that he would like to pursue <br />researching licensing as an additional vehicle beyond saying <br />where these establishments can exist. <br />Attorney Vitunac believed we then would have to set up a <br />licensing division, and discussion continued at length about the <br />advantages of licensing, how it could be done, etc. <br />Commissioner Bowman wished to know if licensing could be <br />included in this ordinance and was informed it would have to be <br />separate. <br />Director Keating agreed that the advantage of the revocation <br />of a license is that it would give the county the ability to go <br />out and actually stop them from operating as opposed to Code <br />Enforcement action, which just has the ability to fine them. <br />Commissioner Bird felt Attorney Vitunac will have to place <br />us on solid legal grounds as to what we can license and what we <br />can't, and Attorney Vitunac felt it would be similar to the <br />occupational license for fortune tellers who are singled out from <br />the general group and have to meet certain tests. <br />11%8f% 28 <br />Er 2 9 a Boy 74 312 <br />
