Acting Administrator Collins stated that it would not affect <br />that at all, and Mr. Maiorana assured the Board that it is the <br />intention of the Property Owner's Association only to protect the <br />property owners' rights to maintain the property as they would <br />like to. They do not have any intention of doing anyone out of <br />their rights to access the beach if they have those rights in <br />their deeds. <br />Vice Chairman Wheeler asked if anyone wished to be heard. <br />There were none, and he thereupon declared the public hearing <br />closed. <br />ON MOTION by Commissioner Eggert, SECONDED by Commis- <br />sioner Bird, Chairman Scurlock being absent, the Board <br />unanimously (4-0) adopted Resolution 88-96 abandoning <br />all of St. Christopher's Lane east of A -1-A. <br />RESOLUTION NO. 88 - 96 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR THE <br />CLOSING, ABANDONMENT AND VACATION OF ALL OF ST. <br />CHRISTOPHER'S LANE EAST OF A -1-A. - <br />WHEREAS, on March 28, 1988, the County received a duly <br />executed and documented petition from the St. Christopher's Beach <br />Property Owners' Association, Inc. of Vero Beach, Florida, <br />requesting the County to close, vacate, abandon and disclaim any <br />right, title and interest of the County and the public in and to <br />St. Christopher's Lane as depicted in the plat of St. Chris- <br />topher's Beach Subdivision Plat Book 3 page 45 lying and being in <br />Indian River County, Florida. <br />WHEREAS, in accordance with Florida Statutes 5336.10, notice <br />of a public hearing to consider said petition has been duly <br />published; and <br />WHEREAS, after consideration of .the petition, supporting <br />documents, staff investigation and report, and testimony of all <br />those interested and present, the Board finds that said <br />right-of-way is not a state or federal highway, nor located within <br />any municipality, nor is said right-of-way necessary for <br />continuity of the County's street and thoroughfare network, nor <br />access to any given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the public in <br />and to that certain right-of-way being known more particularly <br />described as: <br />BEGIN AT THE SOUTHWEST CORNER OF LOT 12, AS SHOWN <br />ON THE PLAT OF ST. CHRISTOPHER BEACH, RECORDED IN <br />PLAT BOOK 3, PAGE 45 OF THE PUBLIC RECORDS OF INDIAN <br />RIVER COUNTY, AND RUN. <br />18 <br />► CI 4'1988 <br />BOOK 74 PAH 415 <br />
