AT OLD DIXIE HIGHWAY <br />Acting Administrator Collins reviewed the following: <br />TO: Board of County Commissioners DATE: September 28, 1988 FELE: <br />SUBJECT: RIGHT OF WAY SETTLEMENT - <br />4TH STREET AT OLD DIXIE <br />HIGHWAY <br />William G. Collins II <br />FROM: Acting County Administrator REFERENCES: <br />The Board has authorized condemnation of the Jaholkowski property at Lith <br />Street and Old Dixie for widening of the intersection. The legal papers are <br />prepared to file. However, Right-of-way Acquisition Agent Donald Finney <br />has continued negotiations with Mr. Jaholkowski. <br />A compromise settlement offer of $15,933 has been - arrived at. Mr. <br />Jaholkowski has also requested that with no trees and no curb, he would like <br />a guard rail on the corner of Old Dixie and 4th Street to protect his <br />remaining property. Settlement will avoid a court suit along with the <br />attendant appraisal fees and legal fees which the County would be required to <br />pay on behalf of both parties. <br />RECOMMENDATION <br />I recommend the Board of County Commissioners approve the settlement <br />outlined above. <br />ON MOTION by Commissioner Eggert, SECONDED by Commis- <br />sioner Bowman, the Board unanimously (4-0) approved <br />settlement with Mr. Jaholkowski as recommended by <br />staff and as described above. <br />OCT 41988 <br />2 8 I1OOK 4 E 425 <br />
