AGREEMENT FOR CULVERT REPAIR & REPLACEMENT OF STRUCTURE <br />(EARNHEART/JORDAN) SEBASTIAN <br />Acting Administrator Collins reviewed the following: <br />TO: Board of County Commissioners DATE:October 12, 1988 FILE <br />SUBJECT:AGREEMENT FOR CULVERT <br />REPAIR/REPLACEMENT OF STRUCTURE <br />FROM -William G. Collins II REFERENCES: <br />'Acting County Administrator <br />A drainage/stormwater pipe passes through property owned by K. L. and B. <br />E. Earnheart and J. R. and D. M. Jordan east of Indian River Drive in <br />Sebastian. This pipe drains a substantial area west of Indian River Drive <br />into the Indian River. This pipe has failed and is causing a washout near <br />the headwall adjacent to Indian River Drive, and a soil collapse under a <br />carport/utility shed on, the property. A title search has determined no <br />easement for the drainage pipe exists. <br />The Earnhearts/Jordans have been very cooperative with the County and are <br />willing to grant the necessary authority to repair the pipe if the County will <br />remove and reconstruct the--_carport/utility shed (or pay the fair market value <br />of the improvements) . <br />Relocating the drainage pipe is not an option. The expense of boring a new <br />line under Indian River Drive, relocating the line, and getting new D.E.R. <br />outfall permits would be prohibitive. The timeframe also would not be <br />acceptable due to the emergency nature of the collapsed pipe. <br />RECOMMENDATION <br />Authorize the Chairman to execute the attached Agreement for culvert/repair <br />structure replacement. <br />The Acting Administrator emphasized that it would be very <br />time consuming to obtain DER permits for relocation and advised <br />that the Public Works Director intends to put in a concrete <br />drainage pipe with an anticipated life of 50-100 years. They <br />estimated the cost of removal and reconstruction would be about <br />$4,000 and fair market value is about the same. <br />MOTION WAS MADE by Commissioner Wheeler, SECONDED by <br />Commissioner Eggert, to authorize the Chairman to <br />execute the Agreement with the Earnhearts and Jordans <br />for culvert repair and replacement of structure. <br />OCT 18 1988 <br />29 BOOK 74 - F E 54 Y <br />
