Commissioner Wheeler commented that he is probably as frus- <br />trated as Commissioner Bird. He agreed property rights are <br />important, but when you look at the brochure and the salesmanship <br />that was used, the property rights of the residents living behind <br />the project are important also. In regard to comparing this with <br />Vero Mall, that mall has three entrance and exits and stili their <br />traffic is definitely a problem. <br />MOTION WAS MADE by Commissioner Wheeler, SECONDED by <br />Commissioner Eggert, to adopt Ordinance 88-46 rezoning <br />10.5 acres of land at the entrance of Vista Royale <br />Gardens to OCR. <br />Commissioner Eggert noted that she has been terribly torn <br />by the conversations she has had with residents and what they <br />seem to have told her they wanted versus what they would get in <br />OCR. She also agreed the owner of this property has certain <br />rights, but when she considered the public safety, health and <br />welfare, she felt we must have the least intensive use there that <br />we can within reason. <br />Chairman Scurlock commented that he was the swing vote on <br />this particular issue when he was 37; now he is 43 and believed <br />he has learned something since. He believed the Board had good <br />intentions; they were swayed by The Village Shoppe proposal and <br />expanded the commercial acreage so that could be done. Now the <br />facts have changed. Mr. Ewing is not going to develop this <br />property; he is going to market it. Chairman Scurlock felt his <br />commitment is to the community. You have to balance rights with <br />responsibility, and he does believe this would be an unsafe <br />situation for that whole corridor. The decision a number of <br />years ago was not a correct decision; he was wrong then; and he <br />now will support the Motion oftered by Commissioner Wheeler as he <br />felt OCR will provide a reasonable use of the property. <br />DEC b 1988 <br />37 <br />800K 75 ME 288 <br />
