Commissioner Bowman stated that her opinion has never <br />changed. She does not feel that CL is the highest and best use <br />of that property. The highest and best use is something like the <br />wetlands in the back that will continue to produce and nourish <br />our river for hundreds of years. <br />THE CHAIRMAN CALLED FOR THE QUESTION on the Motion <br />to adopt Ordinance 88-46 rezoning to OCR. It was <br />voted on and carried 4 to 1 with Commissioner Bird <br />voting in opposition. <br />ORDINANCE NO. 88-46 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR THE <br />PROPERTY DESCRIBED HEREIN AND GENERALLY LOCATED ON THE EAST <br />SIDE OF U.S. HIGHWAY NO. 1, BETWEEN INDIAN RIVER BOULEVARD <br />AND THE SOUTH RELIEFjCANAL AT THE ENTRANCE TO THE VISTA <br />ROYALE GARDENS CONDOMINIUMS, AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, The Planning and Zoning Commission, sitting as the <br />local planning agency on such matters, has held a public hearing <br />and subsequently made a recommendation regarding this rezoning <br />request; and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, did publish and send its Notice of Intent to <br />rezone the hereinafter described property; and <br />WHEREAS, The Board of County Commissioners has determined <br />that this rezoning is in conformance with the Land Use Element of <br />the Comprehensive Plan of Indian River County; and <br />WHEREAS, The Board of County Commissioners has held a public <br />hearing pursuant to this rezoning request, at which parties in <br />interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County <br />Commissioners of Indian River County, Florida, that the Zoning of <br />the following described property situated in Indian River County, <br />Florida, to -wit: <br />38 <br />DEC 6 1988 <br />.BOOK 75 FAGF.289 <br />
