The Board reviewed the following memo dated 12/28/88: <br />TO: The Board of County Commissioners <br />FROM: .(1/William . G. Collins 11 - <br />Acting County Administrator <br />DATE: December 28, 1988 <br />SUBJECT: Building Code Technical Update <br />On November 22, 1988 the Board of County Commissioners <br />accepted the unanimous recommendation of the Indian River <br />County Building Code Board of Adjustment and Appeals to <br />update its Technical Building Codes by adopting the 1988 <br />Editions of the Southern Standard Building Code, Plumbing <br />Code, Mechanical Code, Gas Code, and Housing Code. The <br />Board approved the recommendation and instructed that <br />amendments be prepared for presentation to the Board of <br />County Commissioners for -their review prior to scheduling a <br />public hearing. <br />This ordinance has been scheduled for a public hearing and I <br />request your adoption .of the attached ordinance as an <br />emergency ordinance for the following reasons: <br />1. The changes to our existing ordinance only reflect the <br />use of the 1988 Editions of the Standard Codes. <br />2. The Building Official, Mrs. Rymer, is attempting to have <br />the updated Codes adopted simultaneously by the County and <br />the City of Vero Beach. The City update is scheduled to <br />occur on January 3, 1989. Since the Building Department is <br />a City/County Building Department, it would be difficult to <br />administer two different sets of codes, rather than <br />instituting the updated codes for both jurisdictions <br />simultaneously. <br />3. The 15 -day notice requirement of Florida Statute <br />125.66(2) has not technically been met since our <br />advertisement of the ordinance on December 16, 1988 only <br />provides 13 days' notice of intent to consider the ordinance <br />when Sundays and legal holidays (Christmas and New Year's <br />which when falling on a Sunday are celebrated on a Monday) <br />are excluded from the calculations. <br />The attached ordinance can be adopted by the following <br />procedure: <br />A 4/5ths vote of the membership of the Commission <br />waiving the notice requirements, declaring that an <br />emergency exists and that immediate enactment of <br />said ordinance is necessary. <br />RECOMMENDATION <br />1. By supermajority vote, waive the normal notice <br />requirements, declare the emergency and necessity of <br />enactment of the ordinance. <br />2.
