,JANLt3 1989 <br />sooK 75 F'a r 490 <br />Administrator Collins recommended adopting this ordinance as <br />an emergency ordinance today, and explained that because of the <br />holidays falling on Sundays and celebrated on Mondays, we <br />technically have given only 13 -day's notice instead of the <br />required 15 -day notice. A further reason for an emergency <br />ordinance is that the Building Department is attempting to have <br />the same technical update implemented by the City of Vero Beach <br />through an ordinance tonight, and it would be difficult working <br />under two sets of codes. In order to waive the 15 -day notice, it <br />must have the vote of 4f5ths of the Board, and the Board also <br />must declare that an emergency exists. This way we will be able <br />to send our ordinance to Tallahassee at the same time the City <br />sends theirs. <br />Attorney Vitunac clarified that there actually was a 15 -day <br />notice, but only 13 days of that period are considered legal. <br />Chairman Wheeler opened the Public Hearing, and asked if <br />anyone wished to be heard. There being none, he closed the <br />Public Hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously waived the <br />15 -day notice and adopted, Emergency Ordinance <br />89-3 making additions, deletions and amendments <br />to the Building Code of Indian River County. <br />46 <br />
