Heathe J.1/ <br />Code Enforcement Officer <br />DATE: December 09, 1988 <br />SUBJECT: ESTATE OF NELDA PINTO, DECEASED; PUBLIC <br />NUISANCE: ASSESSMENT FOR ABATEMENT <br />RE: CASE NO. 88-12-740 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regularmeeting of January 10, 1989. <br />DESCRIPTION AND CONDITIONS: <br />On September 27, 1988, code enforcement staff posted a Notice of <br />Public Nuisance, and advertised in the Vero Beach Press -Journal <br />for two (2) consecutive weeks, concerning the illegal presence of <br />trash, debris, and weeds and grasses in excess of eighteen (18) <br />inches in height, on property in Yorkshire Subdivision. The <br />Respondent was cited for an accumulation of trash and debris, and <br />the presence of weeds and grasses in excess of eighteen inches in <br />height, in violation of Sections 13-18(a)(1) and 13-18(b)(1), <br />Public Nuisance', of the Code of Laws and Ordinances. <br />The nuisance violation was not remedied within the thirty (30) <br />day time period. Therefore, in accordance with Section 13-19(b), <br />of the County Code, County personnel (ie: County Road -and Bridge <br />Division) were directed by the County Administrator to abate the <br />nuisance, with the cost to be assessed against the property <br />owner's estate. <br />Section 13-21 of the County Code requires that the cost of abate- <br />ment for the removal of the unserviceable vehicle, vehicle parts, <br />household garbage, junk, trash, discarded building materials, and <br />debris shall be calculated and reported to the County <br />Commissioners, who, by resolution, shall assess such costs against <br />the subject property. This matter is presented herein to the <br />Board for consideration to adopt said resolution. <br />ALTERNATIVES AND ANALYSIS: <br />Section 13-21 (a), Public Nuisance, of the Code of Laws and Ordi- <br />nances of Indian River County specifically reads as follows: <br />"After abatement of nuisance by the county, the cost thereof <br />to the county as to each lot, parcel tract of land shall be <br />calculated and reported to the board of county commissioners. <br />JAN 10 1989 <br />5 <br />BOOK 75 FAbL S3 f <br />
