Pr - <br />JAN 101999 <br />BOOK 75 ME 538 <br />Thereupon, the board of county commissioners, by resolution, <br />shall assess such costs against such lot, parcel or tract of <br />land. Such resolution shall describe the land and state the <br />cost of abatement, which shall include an administrative cost <br />of seventy-five dollars ($75.00) per lot. <br />Such assessment shall be a legal, valid and binding <br />obligation upon the property against which made until paid. <br />The assessment shall be due and payable thirty (30) days <br />after the mailing of notice of assessment after which inter- <br />est shall accrue at the rate of twelve (12) per cent per <br />annum on any unpaid portion thereof." <br />Cost for equipment use, labor, and landfill dumping fees, as in- <br />dicated by the County Road •& Bridge Division, plus the $75.00 <br />administrative cost,calculates to be: <br />Equipment use: <br />Labor: <br />Landfill Charges: <br />Miscellaneous: <br />Administrative fee: <br />TOTAL: <br />$ 408.00 <br />$ 433.68 <br />$ 157.29 <br />$ 96.00 <br />$ 75.00 <br />$1,169.97 <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt the <br />resolution assessing $1,169.97 in abatement costs, in accordance <br />with Section 13-21(a), of the Indian River County Code of Laws and <br />Ordinances. <br />Attorney Collins informed the Board that Nelda Pinto died in <br />a fire over a year ago. The County went in there and did some <br />demolition work on the fire destroyed structure and attempted to <br />notify the heirs, but since then the lot has become overgrown <br />with weeds, and we have had to go back in and maintain the <br />property. Attorney Collins could see this as an on-going <br />maintenance problem, and he would like to be authorized to <br />explore foreclosing the liens we already have against this <br />property and hopefully later sell the property to a private <br />person who will maintain the property. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Eggert, the Board unanimously authorized <br />Attorney Collins to proceed as recommended above. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Scurlock, the Board unanimously adopted <br />Resolution 89-5 assessing the costs of County weed <br />abatement and trash removal against Lots 4, 5 & 6, <br />Yorkshire Subdivision (Estate of Nelda Pinto). <br />6 <br />
