DONALD BROWN:- <br />Tabled <br />ROWN-Tabled from 1-3-89 Meeting <br />The Board reviewed the following memo dated 1/11/89: <br />TO: The Board of County Commissioners <br />FROM:L, -William G. Collins II - Assistant County Attorney <br />DATE: January 11, 1989 <br />SUBJECT: "No Loitering" Ordinance <br />On January 3, 1989 a public discussion item was tabled from <br />the BCC agenda relating to a "No Loitering" ordinance. <br />Sharon Brennan of the County Attorney's Office has <br />subsequently reviewed "No Loitering" ordinances from Ft. <br />Myers and Lee County. She has contacted government <br />attorneys- in Lee County who have informed her that these <br />ordinances have been subject to constitutional challenge but <br />have withstood those challenges in court. <br />Donald Brown, who initiated the request, has contacted <br />Sheriff Dobeck who is supportive of investigating such an <br />ordinance. Copies of the Ft. Myers ordinance, along with a <br />state statute on loitering are attached. <br />Also, F.S. 893.138 provides a procedure for counties to set <br />up administrative boards to abate drug related public <br />nuisances. <br />RECOMMENDATION <br />Explore forming a committee made up of one representative <br />from the Sheriff's Department, one from the State Attorney's <br />Office, one from the County Attorney's Office, and two <br />citizens from the community to determine if any new <br />ordinance would be helpful in deterring the problems <br />identified by Mr. Brown, or if adequate authority exists <br />under existing law. <br />11 <br />JAN 17 1989 <br />0 <br />BOOK <br />uu(;(J <br />
