JAN [' 3 <br />BOOK <br />Ha 610 <br />Commissioner Bird understood that this committee also would <br />explore the need for such an ordinance, and Attorney Vitunac <br />advised that the Board could decide today whether or not an <br />ordinance was needed. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, that the Board approve staff's <br />recommendation which is to establish an ad hoc committee <br />for a limited term for this specific task only. <br />Under discussion, Assistant County Attorney Bill Collins <br />explained that the Sheriff's Office is generally in support of <br />having such an ordinance, but wants to make sure that it would be <br />enforceable and that it is not covered under an existing law. <br />Commissioner Bowman noted that the Lee County ordinance <br />refers to place and buildings, and she felt there might be some <br />question of who owns the right-of-way since that is where the drug <br />dealing takes place. <br />Commissioner Scurlock assumed that is one of the things this <br />committee would explore. He felt that because there are so many <br />unanswered questions in this matter, there is no way the Board <br />could address the subject today. In order to pass an ordinance, <br />we have to follow all the procedures of advertising for a public <br />hearing, etc. <br />Commissioner Eggert pointed out that we are having increasing <br />problems of people loitering within our libraries, and wondered <br />how we would deal with that. Whether that is a city problem or a <br />county problem, it is a problem that will only increase as we <br />build our new libraries. <br />Chairman Wheeler suggested that the Motion include that the <br />Board appoint a representative from each department and Reverend <br />Brown as one community member, and then collectively they can <br />select the second member from the community to serve on the <br />committee. <br />12 <br />
