Commissioner Scurlock felt there is some concern that if <br />Jungle Trail is listed on the National Register, no changes <br />whatsoever could be made to the road. <br />Mrs. Bunnell advised that what it does really is recognize <br />that the entire length of Jungle Trail is an historic trail, aria <br />it really doesn't prevent us from doing anything to that trail. <br />Commissioner Eggert asked if the County totally owns the <br />road and the 30 feet on each side, and Public Works Director Ji <br />Davis advised that the County has filed a maintenance map for <br />portion of Jungle Trail south of CR -510, and it was his <br />understanding that the fact that the County did construct, has <br />maintained the road and has submitted a maintenance map for the <br />record is evidence that the County has ownership of the 40 -ft. <br />road. Carter & Associates did a survey of the road in the 197C <br />to establish the alignment, but to his knowledge, the County ha <br />not filed a maintenance map on the Trail for the portion north <br />CR -510. <br />Commissioner Bowman emphasized that although there may be <br />maintenance map on the northern portion of the Trail, the Couni <br />has maintained it for years. <br />Director Davis did not feek that anyone could contest the <br />fact that the County has prescriptive rights. <br />Commissioner Eggert was concerned that if the 30 -ft. buffa.,r <br />zone was included in the application along with the road's 40 - <br />right -of -way, private property owners might have to seek federal <br />review of their site plans if they planned to make any changes in <br />the buffer zone. She felt that would be a heavy Toad to lay o <br />someone. <br />Mrs. Bunnell stated that only the 7 -mile road itself woul <br />be subject to federal review if any major changes were made. <br />Commissioner Scurlock had very strong concerns about the <br />safety of the road and the need for some alignments on the <br />portion north of CR -510. <br />34 <br />,JAN 2 41989 <br />
