JAN <br />BOOK <br />75 <br />Mrs. Bunnell did not believe that registering the road would <br />hinder the County's ability to realign it for safety purposes. <br />Commissioner Scurlock stated that he would support the <br />endorsement of the Historical Society's proposal contingent on <br />receiving a positive answer to Commissioner Eggert's question <br />about there being no requirement of a federal review for private <br />property'owners making any changes to the buffer area and his <br />question about realigning the road for safety purposes. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, that the Board authorize staff to <br />send a letter to Tallahassee supporting the Historical <br />Society's proposal to nominate Jungle Trail to the <br />Florida National Register Review Board, contingent on <br />the County receiving positive answers to the questions <br />regarding federal review of site plan for private <br />property owners and retaining the ability to realign <br />the road for safety purposes. <br />Under discussion, Director Davis recommended that we go <br />ahead and file the maintenance map for the northern portion of <br />the Trail. <br />Commissioner Bird felt we ought to be consistent for the <br />entire strip of the road, and asked Attorney Vitunac how we stand <br />on the ownership of the road. <br />Attorney Vitunac advised that all the law requires is for us <br />to have constructed the road and maintained it for the period of <br />4 years. He believed the filing of the maintenance map is just <br />an indication to the public that we do own the road, and that not <br />having the map would destroy our title. It would be in our <br />interests to get it on the record so that developers know that we <br />are claiming title. It also defines the exact limits of our <br />claim. <br />35 <br />
