Commissioner Bird asked if we can prove the fact that we <br />have constructed the road, and Director Davis felt you have to <br />take into consideration the fact that over the years the County <br />has added material to it and graded it consistently. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />was voted on and carried unanimously. <br />Mrs. Bunnell thanked the Board for their support, but <br />Commissioner Scurlock emphasized that the letter of support is to <br />be written contingent on finding out that there is no requirement <br />for private property owners to have their site plans go through a <br />federal review and also finding out that the County has the <br />ability to make minor adjustments to the road for safety <br />purposes. <br />Co missioner Bird asked if we have a clear survey of the <br />actual roadbed showing what is our land and what isn't, as far as <br />any la d west of the road. He wondered who owns the property <br />where people are fishing and sunbathing. <br />Director Davis couldn't say generally who owns the <br />riverb nk, but pointed out that the maintenance map that was <br />filed n the portion south of CR -510 did locate the physical road <br />within a 40 -ft. maintenance right-of-way, and that the County is <br />claim <br />g that we maintain the full width of that maintenance <br />right -4f -way. Some portions of the Trail to the west of that <br />alignment are private property, which is why some owners have the <br />right .o put in some docks along the river. It is inconsistent, <br />because in some areas the Trail comes almost to the edge of the <br />river and in other places there is a greater distance between the <br />road and the water's edge. <br />Commissioner Bird felt that one of the most important <br />activities along Jungle Trail is fishing from the bank because <br />anglers are able to cast their lines right out to the channel <br />36 <br />.JAN 241999 <br />ECIMt PLL 684 <br />
