JAN 31 1989 <br />BOOK 75 f,GE 7 <br />Commissioner Bird asked that representatives of the Archery <br />Club be allowed to speak. <br />Greg Cadenhead, president of Indian River Archers, Inc., <br />came before the Board. He had a question regarding the provision <br />under Item 9 of the proposed agreement which says the licensed <br />premises are to be open to the general public except when <br />organized events are being held, and then on the previous page <br />under Liability says the County shall not be liable for any loss, <br />injury, etc., to anyone who at any time may be using the licensed <br />premises. Mr. Cadenhead felt the corporation should be liable <br />only when they are actively using the premises, not when they <br />aren't there. <br />Commissioner Bird believed the concept presented was that <br />the facility will be developed by the Archers club and only <br />people who are members of the club and covered by their insurance <br />will be allowed to use the facility. There was talk about having <br />the public have the ability to use the range, but only on a <br />supervised basis. <br />Attorney Brennan advised that we have to make a non- <br />exclusive license agreement because the land is dedicated to be <br />used by the public, and she would recommend against having any <br />archers going out there unsupervised. <br />Commissioner Scurlock agreed it must be open to the general <br />public but only under certain conditions. <br />Discussion continued as to the possible liability that could <br />be encountered, whether people could be required to be a member <br />of the club, how the access would be controlled, etc., and <br />Commissioner Bird felt with any outdoor activity there is some <br />element sof risk, and the Commission must decide whether it is <br />worth it. <br />Commissioner Scurlock believed the Commission is receptive <br />to the proposal and that staff should work out details to provide <br />a way to do this safely. <br />54 <br />
