Commissioner Bird referred to a map showing the portion of <br />the property deeded to the county on the south side of the Inlet, <br />and pointed out that we basically are land locked since the State <br />owns land completely encircling our property. He informed the <br />Board that the state said no to the first two options proposed in <br />his letter, which were first to allow County residents to access <br />the southside of Sebastian Inlet Park with no fee, or second, to <br />lift the deed restriction in exchange for yearly free passes for <br />County residents. In regard to the third option, which was to <br />charge fees with all those fees to be used only for operation and. <br />maintenance of that park, they agreed they would lobby the <br />Legislature to accomplish that. We wanted to know what assur- <br />rance we have if that doesn't come about and in the meantime we <br />have waived our deed restrictions, and the DER stressed that <br />while they would make every attempt to convince the Legislature <br />this should be done, they cannot control the Legislature. The <br />agreement they have sent us asks us to waive our deed restric- <br />tions in return for the DNR making every attempt to see that all <br />fees collected at the Park stay there. We were not real com- <br />fortable with that agreement, and Attorney Brennan asked the DNR <br />if we could possibly agree to waive the deed restrictions on an <br />interim basis to see how it goes over the next year or two. At <br />that point, it appeared they would not be agreeable to that <br />proposal, but after more urging, it seems that Attorney Collins <br />got a somewhat different reaction. <br />Attorney Collins reported that the general feeling he got <br />from the Board is that in the agreement proposed, we are just <br />giving away what the County has and there must be a better way <br />than just relying on the DNR to try to follow through. He <br />discussed this with Randy Lewis, a Director of the DNR, who got <br />concurrence from Tom Gardner, Executive Director, that we <br />essentially could modify the language in Paragraph 1 of the <br />proposed agreement to state that the County shall, within 60 days <br />of the date of this Agreement, prepare and record the documents <br />63 <br />FEB 7 '989 <br />BOOK 6 PAGE 63 <br />
