Heathe&l# ' <br />Code Enforcement Officer <br />DATE: December 30, 1988 <br />SUBJECT: RELEASE OF EASEMENT PETITION BY: <br />ROBERT N. & CONSTANCE W. MORSELLI, <br />6100 60th COURT, VERO BEACH, FL. <br />SUBJECT PROPERTY: KINGSLAKE SUB- <br />DIVISION, LOT 21 <br />RE: MORSELLI MEMO DISK. REMS/CHEATH <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of February 14,1989. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Robert & Constance Morselli, <br />owners of the subject property, for the release of a two (2) foot <br />portion of the easterly thirty (30) foot utility and drainage <br />easement, being the westerly two (2) feet of the easterly thirty <br />(30) feet of Lot 21, Kingslake Subdivision, Section 08, Township <br />32 South, Range 39 East, Indian River County, Florida; according <br />to the Plat thereof as recorded in Plat Book 10, Page 95, of the <br />Public Records of Indian River County, Florida. It is Mr. & Mrs. <br />Morselli's intention to effect compliance with Indian River County <br />regulations by releasing that part of the easement into which a <br />two (2) foot portion of the roof eave overhang would encroach. <br />The current zoning classification of the property is RS -3, Sin- <br />gle -Family Residential District. The land use designation is <br />LD -1, Low Density Residential, up to three (3) units per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by the Southern Bell Telephone <br />Company, Florida Power & Light Company, Florida Cablevision <br />Corporation, and the Indian River County Road & Bridge Division, <br />Engineering Division, and the Utilities Department. There were <br />two (2) objections to the release, from the Engineering Division, <br />and the Road & Bridge Division, who stated that the entire platted <br />easement would be needed for future drainage improvements. <br />114 <br />
