which is what Director Keating suggested - have Sea Oaks agree to <br />live up to the Plan whenever it is adopted a month or two from <br />now. He noted that every other development on the Trail will <br />have to live up to what is going to be adopted, except for this <br />one gap at Sea Oaks, and Attorney Barkett wants to rush in and <br />beat all the other plans. Staff is charged by an ordinance <br />already adopted saying that we will have the Board adopt rules by <br />Resolution, and Attorney Barkett is not right when he says it is <br />illegal and highway robbery for him to agree to a Management Plan <br />that we are going to adopt in six weeks. Every other developer <br />will be using that plan, and it will protect all the interests. <br />Commissioner Bird wondered whatever happened to the fairness <br />of playing the game by the rules that are in effect the day you <br />play the game. He pointed out that we have had 4 years to adopt <br />this plan, and we haven't done it; so, he does not feel Sea Oaks <br />is rushing in to beat some deadline. <br />Attorney Vitunac believed we all understood we had interim <br />protections available, and that is what this is today. <br />Argument continued at length. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Bowman, to table action on the Sea Oaks <br />request for one week until February 28th to get better <br />information as to the options we have. <br />Commissioner Bowman commented that she had problems with the <br />"opaque" requirement. She did not think the original trail was <br />ever opaque before the Brazilian pepper trees took over, and she <br />had a problem with anything that resembles a hedge. <br />Commissioner Eggert explained that she wanted more informa- <br />tion because staff's requirement specifically says there must be <br />a continuous native vegetation screen 10-15' high along the edge <br />of the road R/W and that has her bothered.
