In conclusion, Mr. Dolan respectfully requested the Board to <br />give consideration to the paving of 134th Street and the removal <br />of the barricade at the end of 134th Street. In addition, he <br />asked that consideration be given to a controlled barricade which <br />would provide limited use of 134th Street for approximately 10 <br />hours a week. <br />Commissioner Eggert asked why the Sebastian Police weren't <br />continuing to handle the traffic on Saturdays and Sundays, and <br />Mr. Dolan explained that during the time the road improvements <br />were being made, the Sebastian Police Department provided two <br />officers to help people get out onto U.S. #1. However, after the <br />improvements were made, they said it would be a burden to <br />continue to provide two officers, and two officers were necessary <br />at that location. <br />Commissioner Eggert asked if they had made any attempt to <br />hire any off-duty officers, and Mr. Dolan explained that there <br />was the problem of insurance, etc. <br />Commissioner Scurlock understood that the road is now <br />blocked off and there are some people who are trying to get <br />around the barricade, but Director Davis believed that instead of <br />trying to get around the barricade, some people are parking prior <br />to the barricade and just walking over to the church. <br />Chairman Wheeler pointed out that the purpose of today's <br />meeting is just to determine whether to set a public hearing <br />date. <br />Commissioner Scurlock asked if the County would be liable <br />for anything that happened on U.S. #1 if the church sued us for <br />not providing a safe or safer access, and Attorney Vitunac <br />advised that if we put up an improper stop sign or traffic <br />control device, we would be liable for that, but we would be <br />totally immune from liability on a decision to open or close a <br />road. <br />141989 <br />15 BOOK 76 f',,G1-.363 <br />
