BACKGROUND AND CONDITIONS: <br />At its regular meeting of February 28, 1989 the Board of County <br />Commissioners voted unanimously to "conceptually" approve the <br />Harbor Town Center development order (D.O.) subject to some <br />language changes to be finalized and approved at the March 14, <br />1989 Board meeting. Taking into consideration the concerns and <br />ideas expressed by the Board at the February 28th meeting, staff <br />researched alternatives and produced several "working draft" <br />iterations that were reviewed and commented upon internally and by <br />the applicant and its agents. Staff now proposes revisions to the <br />D.O. <br />ANALYSIS AND ALTERNATIVES <br />Although the Board discussed and clarified several items within <br />the D.O. regarding landscaping/open space, bumper stops, drainage, <br />utilities, and fire protection, it was concluded that only two <br />issues needed to be more adequately addressed via revisions to the <br />D.O. These two areas relate to stormwater discharge and construc- <br />tion deadlines. <br />°Stormwater Discharge <br />Although the ADA includes an acknowledgement by the applicant that <br />the project is not within the Indian River Farms Water Control <br />District and that the project cannot legally and will not dis- <br />charge stormwater into the North Relief Canal, nothing in the <br />originally proposed D.O. specifically prohibited discharge into <br />the Canal. (It was verified by the Public Works director that the <br />developer may be able to obtain a legal positive outfall to the <br />Indian River, with all applicable stormwater quality standards <br />being met.) <br />To ensure that the project will not discharge stormwater into the <br />North Relief Canal, staff proposes the following sentence be added <br />to the beginning of condition #12 of the D.O.: <br />"No stormwater shall be discharged from the site into the North <br />Relief Canal." <br />°Construction Deadlines <br />The originally proposed D.O. established three construction <br />deadlines: a three-year (1992) deadline for commencement of any <br />portion of the project; a December 31, 1993 deadline for <br />commencement of the mall; and an estimated December 31,. 1996 <br />deadline for total project completion. The Board expressed the <br />desire to specifically ensure reasonable construction progress of <br />the mall and to ensure that development of the commercial out - <br />parcels outside of the area along U.S. #1 currently zoned <br />commercial did not precede development of the mall. <br />Staff proposes a complete "re -write" of condition #2, which <br />provides for the following: <br />1. a three-year deadline for commencement of construction for <br />some portion of the project: either an outparcel/residential <br />area or the mall [Condition 2.a.] (NOTE: in staff's <br />opinion, only a minimal amount of outparcel development <br />should be required within this condition: extensive outparcel <br />development should not be encouraged early on in the pro- <br />ject's development); <br />19 ElOOK <br />WAR 14 98 <br />
