[BAR28 939 <br />BOOK 76 F"GE 45 4 <br />Mr. Boling next reviewed the access management plan that <br />will protect the manatees and the seagrass beds from boat <br />traffic. <br />Commissioner Scurlock asked if there was any provision for <br />continued maintenance of the drainage canal as he was concerned <br />that the County might be faced with the problem of maintaining <br />the canal somewhere down the road, which was the problem the <br />County encountered with the 14th Street canal in the Rockridge <br />Subdivision. <br />Mr. Boling explained that the Florida Department of Trans- <br />portation (DOT) have to be involved in getting the necessary <br />permits, but the money would have to come from somewhere else. <br />Commissioner Scurlock felt the long-term responsibility for <br />maintaining these access canals along the river should be spelled <br />out in the site plan. <br />Vice Chairman Eggert understood that this would be part of <br />the traffic management plan and although, they would have to work <br />with the DOT, they would have to bear the cost themselves. <br />Mr. Boling confirmed that would be the case if any <br />maintenance was involved. Basically, this boat ramp facility is <br />a shared facility, the same as a single family dock. <br />Commissioner Scurlock wanted to see it all down in black and <br />white so that if a time comes when the canal cannot be navigated <br />any longer, the entities of the development have agreed to <br />maintain the canal. <br />Commissioner Bowman pointed out that the bottom lands to the <br />east, the ones they are going to travel over, belong to River <br />Shores and were deeded to Mr. Lowenstein, but Mr. Boling advised <br />that staff checked with the County Attorney's office and while it <br />is true that the bottom lands are privately owned, the public has <br />a right to go over them as long as there is water over them and <br />it is navigable. <br />Commissioner Bowman emphasized that they don't have a right <br />to dredge the canal, and wanted to know who would dredge it in <br />14 <br />
